РЕГІОНАЛЬНІ ПАРЛАМЕНТИ ДЕРЖАВ ЄС В УМОВАХ ДЕЦЕНТРАЛІЗАЦІЇ: ФОРМУВАННЯ, ФУНКЦІОНАЛЬНЕ ЗНАЧЕННЯ, УЧАСТЬ У СИСТЕМІ МІЖПАРЛАМЕНТСЬКОЇ ВЗАЄМОДІЇ

Анотація
У статті розглядається важлива роль регіонального парламентаризму в контексті міжпарламентської взаємодії Європейського Союзу, зокрема в межах Системи раннього попередження (далі – СРП). Зміст статті зосереджено на аналізі етапів розвитку регіоналізму в ЄС, починаючи з його значного ігнорування на етапі європейської інтеграції та поступового переходу до активнішої участі регіональних парламентів у процесах ухвалення рішень на рівні ЄС. Важливим чинником цього процесу є Лісабонський договір, який суттєво змінив роль регіональних парламентів, надаючи їм часткову участь у законодавчому процесі ЄС, зокрема в контексті дотримання принципу субсидіарності. Одним із ключових аспектів статті є розгляд принципу субсидіарності як основи для участі регіональних органів у перевірці законодавчих ініціатив ЄС, через механізм СРП. Важливу увагу приділено вивченню юридичних актів, що стали основою для розвитку регіонального парламентаризму, а також прикладів його реалізації в різних країнах ЄС, як-от Німеччина, Бельгія, Велика Британія, Італія та Іспанія. У статті детально розглянуті виборчі процедури, що визначають формування регіональних парламентів у різних країнах ЄС, що є важливим аспектом для розуміння їхньої участі в СРП. Зокрема, стаття аналізує, як політичні системи та рівень автономії регіонів у різних країнах впливають на їхню здатність брати участь у перевірці відповідності європейських законодавчих ініціатив принципу субсидіарності. Досліджуються варіанти участі регіональних парламентів у різних країнах, зокрема, коли їхня роль обмежена лише консультаціями через національні парламенти, а в інших випадках – їх участь може бути значною, як це спостерігається в Німеччині чи Австрії. Висновки статті свідчать про те, що, попри певні досягнення в інтеграції регіональних парламентів у процеси ЄС, їх вплив на законодавчий процес залишає бажати кращого в низці країн. Для забезпечення більшої ефективності СРП необхідно розширювати права регіональних органів влади, посилюючи їх участь у процесі ухвалення рішень ЄС, а також забезпечити більшу прозорість та доступ до ресурсів для більш активної роботи в межах цієї системи.
