REFORMING THE ELECTORAL PROCEDURES OF THE EUROPEAN PARLIAMENT IN THE CONTEXT OF A CRISIS OF LEGITIMACY

Abstract
The article analyses the legal and institutional aspects of the formation and development of the electoral system for the European Parliament, taking into account the challenges to its efficiency, legitimacy and representativeness. The legal basis for electoral procedures is provided by the articles of the EU founding treaties, the Charter of Fundamental Rights and legislative acts, in particular Council Directive 93/109/EC and its amendments. The main challenges include the diversity of electoral systems in the Member States, low voter participation, interethnic diversity, transnational representation and transparency of electoral processes. Proportional representation is the main electoral system, but there are significant differences in its implementation, including the possibility of preferential voting. An important aspect is the introduction of common standards for elections that promote democracy and ensure the representation of EU citizens. Efforts to reform electoral procedures, including the introduction of mandatory electoral thresholds, are aimed at increasing the efficiency and legitimacy of elections. The article also examines the historical aspects of the European Parliament, the role of key founders such as Jean Monnet and Alterio Spinelli, and analyses the work of contemporary authors in this area. Amendments to the electoral legislation, including Council Decision 2018/994, require ensuring the integrity of the results, secrecy of the vote and protection of personal data. The electoral process also includes issues of incompatibility of offices and balancing national and European interests. The problems of democratic legitimacy, functional efficiency and inter-institutional relations remain relevant for the further development of the European Parliament as a central body of European democracy and integration.
